Notice on Carrying out Screening of Associated Technical Organizations for Food-related Products Safety Monitoring

 

Quality and Technical Supervision Bureaus (Market Supervision and Management Departments) of all provinces, autonomous regions and municipalities directly under the Central Government, and all relevant technical organizations,

    According to the provisions of the Food Safety Law of the People’s Republic of China, food-related products refer to packing materials and containers used for foods, including paper, bamboo, wood, metal, enamel, ceramic, plastic, rubber, natural fiber, chemical fiber, glass and other products used to pack and contain foods or food additives, as well as paints in direct contact with foods or food additives; tools and equipment used in food production and trading, including machinery, pipeline, conveyers, containers, utensils and tableware in direct contact with foods or food additives in the production, sales and use process of foods or food additives; detergents and disinfectants used for foods, including substances directly used for washing or disinfection of foods, tableware and kitchenware, tools and equipment or food packing materials and containers in direct contact with foods. In order to better carry out food-related products safety supervision and management work according to products of different textures, and ensure the scientificness and fairness of associated technical organizations undertaking food-related products safety supervision and management tasks, our Department intends to carry out the screening of associated technical organizations for food-related products safety supervision and management, and has thus formulated a Plan for the Screening of Associated Technical Organizations for Food-Related Products Safety Supervision and Management (see the Annex, hereinafter referred to as the Plan). Relevant matters are hereby notified as follows:

    I. Working Procedures

    According to the requirements of the Plan, after this Notice is issued, all relevant technical organizations may provide written application dossiers to our Department, and our Department will organize experts to carry out preliminary review and expert evaluation of the application dossiers and form a candidate list of eligible technical organizations according to their ranking sequence. Then when carrying out food-related products supervision and management work, our Department will choose technical organizations from the candidate list according to characteristics and specific requirements of the work.

     II. Job Requirements

    Eligible technical organizations volunteer to participate, and Quality and Technical Supervision Bureaus of all provinces, autonomous regions and municipalities directly under the Central Government are responsible for communicating the requirements to the technical organizations in their provinces. Technical organizations shall submit relevant materials as required.

Plan for the Screening of Associated Technical Organizations for Food-Related Products Safety Supervision and Management

    I. Purpose of Organization Screening

   According to the provisions of the Food Safety Law of the People’s Republic of China, food-related products refer to packing materials and containers used for foods, including paper, bamboo, wood, metal, enamel, ceramic, plastic, rubber, natural fiber, chemical fiber, glass and other products used to pack and contain foods or food additives, as well as paints in direct contact with foods or food additives; tools and equipment used in food production and trading, including machinery, pipeline, conveyers, containers, utensils and tableware in direct contact with foods or food additives in the production, sales and use process of foods or food additives; detergents and disinfectants used for foods, including substances directly used for washing or disinfection of foods, tableware and kitchenware, tools and equipment or food packing materials and containers in direct contact with foods. In order to better carry out food-related products safety supervision and management work according to products of different textures, highlight full-process supervision and management before, during and after the event, scientifically and fairly choose associated technical organizations, the Quality Supervision Department of the General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the Supervision Department) will carry out the screening of associated technical organizations for food-related products safety supervision and management (hereinafter referred to as technical organizations).

   II. Principle for the Screening of Organizations

   According to the requirement of the State Council for utilizing more social forces in public service fields and strengthening the government’s purchase of services, the Department will adhere to the principle of fairness, competition and merit, and choose domestic and foreign organizations whose technical capacity is appropriate to the project demand.

III. Categories of Organizations

Technical organizations are classified into paper, bamboo, wood, fiber, metal, enamel, ceramic, plastic, rubber, glass, disinfectant, detergent, paint, ink and other categories by texture; testing, certification, evaluation and identification by nature; quality and safety control of the production and processing processes & quality and safety control of final products of food-related products by technical capacity.

    IV. Responsibilities of Organizations

    Technical organizations include the following responsibilities: undertake risk evaluation of corporate production key points, sample collection, testing, certification and other work according to the job requirements for supervision and management of the General Administration of Quality Supervision, Inspection and Quarantine; truthfully record data, and submit data and working situation on time as required; analyze the data, and write analysis reports; propose suggestions for implement and strengthening of relevant work, etc.

    V. Requirements for the Capacity of Organizations

The current screening work will focus on investigating the capacity of technical organizations in terms of organizational requirements, laboratory capacity, relevant scientific research capability, support for the government’s regulatory work, talent team and other aspects.

(I) Organizational requirements

1. The organizations shall be legally established (registered) or relatively independent organizations that can assume legal liability; for non-independent legal person technical organizations, the legal representative of their legal person organizations or authorized person thereof shall be responsible and assume liability.

2. Appropriate working systems shall be developed, and the organizations shall have the organizational and management mechanisms and coordinating capacity required for completion of the tasks.

3. The organizations are not allowed to hire personnel who are prohibited to engage in food and food-related products inspection work according to the provisions of laws and regulations. 

(II) Laboratory capacity

1. The organizations shall have a sound laboratory quality management system, and have passed the relevant qualification certification for the testing of food-related products of relevant textures;

2. The organizations shall have the instruments and equipment, laboratory environmental facilities, and safe and effective information management systems required for the testing of food-related products of relevant textures; 

3. The organizations shall have the experience of laboratory comparison or proficiency testing in relevant texture fields.

(III) Relevant scientific research capability

     1. The organizations shall have presided over or participated in national or provincial or ministerial-level scientific research projects in food-related products risk testing, certification, assessment, identification and other aspects;

    2. The organizations shall have presided over or participated in the formulation (revision) of national or industry standards for food-related products;

    3. The organizations shall have the experience of domestic and foreign technical exchanges and cooperation on food-related products.

    (IV) Related work experience

    The organizations shall have relevant work experience in undertaking food-related products testing, certification, assessment, identification and other work, and have never encountered accident at work or violated laws and disciplines. 

(V) Talent team

1. The organizations shall have no fewer than 10 professional technical personnel in relevant texture fields, including no less than 60% of personnel with intermediate and above professional technical positions;

2. Pace-setters in scientific research shall have senior professional technical positions, high academic influences in relevant texture fields, and have undertaken provincial and ministerial-level scientific research projects.

   VI. Working Procedures for Screening

   (I) Initiation of screening

    Initiate the screening work of technical organizations in accordance with the task demands of Supervision Department of the General Administration of Quality Supervision, Inspection and Quarantine for food-related products safety supervision and management work.

    (II) Organization registration

    Technical organizations may voluntarily apply for screening, fill out an Application Form of Technical Organizations for Food-related Products Safety Supervision and Management (see the Attachment), and submit it to the Supervision Department.

    (II) Preliminary screening of organizations

    The Supervision Department will organize experts to review the application dossiers submitted by technical organizations to form a candidate list.

    (IV) Determination of organizations

    The Supervision Department may choose the appropriate technical organizations to undertake various food-related products supervision and management works according to specific job requirements.

    VII. Management and Assessment of Organizations

    The Supervision Department will carry out daily management and assessment of technical organizations, including proficiency testing, approval of test results, flight inspection and other methods, and form organization management and assessment records. After organizations undertaking various food-related products supervision and management work tasks, the Supervision Department will conduct quality assessment of their task completion status in terms of work execution rate, work effectiveness, work discipline and other aspects. The results of proficiency test and work quality assessment will serve as an important basis for the screening of technical organizations.

    In the event of major problems of technical organizations undertaking relevant work tasks at work, or after whistle-blowing is proven true, the Supervision Department will expel the organizations out of the candidate list, and order them for rectification. After rectification, such organizations may re-file an application.

1. All application dossiers filled and submitted by the applicant organization must be authentic, legitimate and valid.

2. If the applicant organization has the supportive technical capacity for safety supervision and management of products of two or more textures, it shall specify the corresponding applied textures and the conditions of organization category in “Conditions of the Organization” in detail respectively. More pages can be attached if the pages of this form are not enough.

3. Relevant certificates, documents of proof, profile introduction and other materials of the organization can be additionally attached, bound into a book and affixed with a seal on the perforation.
