2. Administering Organ:

   The AQSIQ authorizes the China Promotion Committee for Top Brand Strategy to organize and carry out the evaluation of China Top Brand Products in a unified way. The China Promotion Committee for Top Brand Strategy is a non-permanent body composed of specialists from the relevant national social organizations, government departments, some press units and other relevant circles. The Secretariat of the China Promotion Committee for Top Brand Strategy is set up under the Quality Department of the AQSIQ.

 

3. Promotion System of Top Brand Strategy and Principles of Evaluation

Promotion System: it is a general promotion system which is established based on the market evaluation, considering the enterprises as the main body, guaranteed by the guidance, active promotion and supervision of the government and aiming at the consumers’ satisfaction.

Principles of Evaluation: to be scientific, just, fair and open; to insist on no charging for enterprises, no additional burdening for the enterprises and absence of lifelong tenure.

 

4. Application Requirements

(1) An application enterprise shall comply with the relevant provisions of laws, regulations and industrial policies of the state;

(2) Quality of the products shall take the lead among domestic like products and reach the internationally advanced level; the market share, rate of earning foreign exchange through export and brand awareness shall all be in leading positions among domestic like products;

(3) The annual sales, realized tax and profits, ratio of profits to total industrial costs and the total asset contribution rate shall all occupy the leading place in the related field;

(4) The enterprise shall have advanced and reliable production techniques and equipment, and lead the industry in technological innovation and development of products;

(5) The products shall be produced in accordance with the national standards which are formulated based on the international standards or advanced foreign standards;

(6) The enterprise shall have a sound and complete metrological measurement system and a guaranteed measurement capacity;

(7) The enterprise shall have a sound quality management system that is in effective operation, and have not experienced any serious quality accident;

(8) The enterprise shall have a sound and complete after-sale service system with a high level of customers’ satisfaction; and

(9) The enterprise shall meet all the minimally qualified requirements prescribed in the year of the application.

 

Those in any of the following circumstances may not apply for the title of “China Top Brand Product”:

(1) Using a foreign (overseas) trademark;

(2) Being subject to the administration of production license, China Compulsory Certification and license of manufacturing measuring instruments, etc. but failing to obtain a related license,

(3) Having any record of failure in a selective examination conducted by a  quality supervision institution at the level of province (municipalities directly under the Central Government or autonomous region) or above in the past 3 years;

(4) Having any record of failure in an export commodity inspection in the past 3 years; or having been claimed for compensation by a foreign country in terms of the exported products in the past 3 years;

(5) Having encountered a quality or safety accident in the past 3 years, or having met with a major quality complaint which has been verified to be true; and

(6) Having committed other serious violations of laws and regulations.

 

5. Procedures & Flows

(1) To determine the catalogue of products subject to the evaluation of China Top Brand Products;

(2) To put forward the requirements of application;

(3) To organize the application in all provinces throughout the country;

(4) To promulgate the application information in every related province;

(5) To organize competent committees of experts;

(6) To carry out evaluations;

(7) To determine and promulgate the preliminary list of China Top Brand Products;

(8) To deal with opinions collected after the promulgation;

(9) To determine the final list of China Top Brand Products by the China Promotion Committee for Top Brand Strategy; and

(10) To award qualified enterprises the title of “China Top Brand Product” by the AQSIQ.

 

6. Contents of Application Materials

The table of application materials can be downloaded from www.aqsiq.gov.cn or www.cqs.gov.cn. At present, following documents shall be submitted for the application for China Top Brand Products:

(1) An overview of the application for China Top Brand Products;

(2) The basic information of the enterprise (Table 1);

(3) The table of declaration and overall evaluation of the enterprise (Table 2);

(4) The table of basic information about the sales volume and sales amount of the candidate products in the past 3 years (Table 3);

(5) Comments of provincial bureaus of quality and technical supervision, which integrate the comments of relevant departments with that of related social organizations (Table 4);

(6) Certification documents (the originals, duplicates or the scanning documents):

1) Two photographs of the candidate products, their product lines and the panorama of the enterprise, the Business Registration Certificate of the enterprise and the trademark registration certificate;

3) Other basic certificates (including the CCC certificate, market access certificate for food security, production license, license of measuring instruments, quality license for export and the license of sanitation registration and administration for exported food, etc.);

4) Testimonials of sales volume and amount issued by departments of statistics at a provincial level or above;

5) Testimonials of export volume and amount issued by the Customs or the administration of foreign exchange;

6) Ratal proofs issued by competent provincial taxation bureaus;

7) Certificates of adopting the international standards or advanced foreign standards and the duplicates of the first pages of adopted standards;

8) A test report of main performance indexes of the submitted products;

9) The certificate for quality management advanced enterprise awarded by the AQSIQ;

10) A certificate of provincial quality management awards;

11) A certificate of provincial top brand product;

12) A certificate of well-known trademark;

13) Certificates of quality system certification and environment quality system certification;

14) A certificate of HACCP certification;

15) A certificate of energy conservation product certification;

16) Documents indicating the number of persons who obtain the professional qualification certificate for quality personnel and serial numbers of such certificates; 

17) Description of the construction of after-service counters, “three guarantees of quality” and the disposal of consumers’ suggestions and advices;

18) A certificate of Measurement Management System certification;

19) A certificate of A Good Enterprise with Better National Standardization Behaviors;

20) Relevant statements issued by a competent public accounting firm (balance sheet, income statement, etc.);

21) A new product certificate (at a provincial level or above);

22) A letter patent and related lists;

23) A national or provincial qualification certificate of technology center of the enterprise;

24) A certificate of national or provincial award for science and technology advancement;

25) A testimonial of building postdoctoral research stations for the enterprise; and

26) A testimonial of that the enterprise has participated in the revision of industrial standards, national standards or international standards.

 

7. Fees

No fee shall be charged for the evaluation and awarding of China Top Brand Products.

 

8. Period of Validity

A certificate of China Top Brand Products shall be valid for three years. During the period of validity, enterprises may use the unified sign of China Top Brand Products on products awarded the title of “China Top Brand Products”, their packages, decoration, instructions, advertising and other related materials on which the period of validity shall also be indicted.

 

9. Archival Filing of Using the Sign of China Top Brand Products

For products processed by a new subsidiary company, branch, or an entrusted agency which could meet the requirements of archival filing, the enterprise may use the sign of China Top Brand Products after going through the formalities of archival filing. First, the local provincial bureau of quality and technical supervision shall check the documents for archival filing, and then report them to the AQSIQ after approval. The Quality Department under the AQSIQ will reexamine and confirm the written materials and then promulgate the contents of archival filing. For using the sign of China Top Brand Products, the new subsidiary company, branch or the entrusted agency shall mark the address, name and telephone number of the manufacturer. Following documents shall be submitted for archival filing: application materials, inspection reports issued by product quality inspection institutions at a provincial level or above, the business registration certificate, a commission contract for using the trademark, lists of product specifications and documents involving the contact person, postcode, telephone numbers, fax and other contents.

 

10.  “Ten Prohibitions” for the Evaluation Work of China Top Brand Products:

(1) To prohibit related entities under the Quality Inspection System, China Promotion Committee for Top Brand Strategy (hereinafter referred to as the Brand Promotion Committee) and relevant medium organizations, in the name of the evaluation of China Top Brand Products, and prohibit from charging the application enterprise, from engaging in any form of advertising, sponsorship, ranking, recommendation or other activities;

(2) To prohibit related personnel involved in the evaluation from accepting gifts, cashes, securities, or payment documents, or asking the application enterprise to make the reimbursement of their personal expenses;

(3) To prohibit related personnel involved in the evaluation from joining junketing, entertainments or other activities which would have an influence on the equity of the evaluation;

(4) To prohibit related personnel involved in the evaluation from any on-the-spot investigation, consultation or lecture at the application enterprise during the evaluation;

(5) To prohibit members of the professional committee involved in the evaluation from publicizing the identities of themselves or other personnel involved, and making benefits for themselves or their units by using their identities;

(6) To prohibit relevant persons who have a relationship with the application enterprise and might have an influence on the equity of the evaluation from being involved in the evaluation of China Top Brand Products;

(7) To prohibit related personnel involved in the evaluation from violating the Non-Disclosure Agreement or from disclosing information concerning the evaluation;

(8) To prohibit related personnel from disclosing the enterprise’s business secrets or technical know-how, and protect its intellectual property rights;

(9) To prohibit related personnel from being involved in or sheltering the falsification made by the application enterprise, to check application materials and information strictly, and to ensure an objective and fair evaluation; and

(10) To prohibit any entity or individual from interfering with the evaluation of China Top Brand Products.

The above “Ten Prohibitions” shall be applicable to related entities and individuals involved in the evaluating process of China Top Brand Products. Related personnel involved in the evaluation refer to members of the Brand Promotion Committee and all professional sub-committees as well as staff of relevant industrial associations and the Secretariat of Brand Promotion Committee. The period of evaluation starts with the application for China Top Brand Products and ends with the completion of evaluation. Entities under the Quality Inspection System, if fail to abide by the “Ten Prohibitions” shall be punished strictly according to relevant provisions on building a clean and honest government formulated by the AQSIQ; and those that are member entities of the Brand Promotion Committee, if fail to abide by the “Ten Prohibitions” shall be disqualified from being the member entities. Furthermore, individuals failing to abide by the “Ten Prohibitions” shall be disqualified from being members of the Brand Promotion Committee or being involved in the evaluation. In addition, those who are suspected to break rules, regulations or laws shall be handed over to relevant competent authorities for handling.
