I  FAQs on Quarantine of Postal Articles

1.What’s the legal basis for quarantine of entry-exit postal articles?

In order to better execute the quarantine of entry and exit postal articles; to prevent infectious diseases, verminosis, dangerous insects, pests and weeds, and other harmful living things within the postal articles from being introduced into or taken from the borders; and to protect the production safety of agriculture, forestry, animal husbandry and fishery and the health of the people of our country, the inspection and quarantine institution shall perform quarantine on entry and exit postal articles (with the exception of  the various kinds of express parcels operated by postal agencies and other departments) in accordance with relevant laws and regulations such as the Law of People’s Republic of China on Entry and Exit Animal and Plant Quarantine and its regulations for implementation, the Law of the People’s Republic of China on Health Border Quarantine Inspection and its detailed rules for implementation, the Postal Law of People’s Republic of China and its detailed rules for implementation, and the Measures for Quarantine Administration of Entry and Exit Postal Articles, and other relevant laws or regulations.

2. What kinds of postal article shall be subject to animal and plant quarantine?

(1) Entry animals and plants, animal and plant products and other quarantine objects;

(2) Entry and exit microorganisms, human organisms, biotic products, blood and blood products, and other special articles;

(3) Postal parcels that come from an epidemic area and that are contaminated by a infectious disease subject to quarantine or that may act as a vehicle of the said infectious disease;

(4) Botanic packaging, matting materials used by or taken with entry and exit postal articles; and

(5) Other entry and exit postal articles that need quarantine in accordance withthe provisions of laws, regulations and international treaties.

3. How to post plant seeds, seedlings, and other propagating materials into China?

For plant seeds, seedling trees and their propagating materials sent into the borders, the recipients shall undergo the procedures for examination and approval at the relevant departments in charge of agriculture or forestry. Should the procedures cannot be conducted in advance because of special circumstances, the recipient shall apply to the port of entry inspection and quarantine bureau directly under AQSIQ to undergo quarantine procedures.

Where entry plant products sent through post need to undergo quarantine procedures, the recipient must apply in advance to the AQSIQ, or the inspection and quarantine bureau authorized by and directly under the AQSIQ at the place where the port of entry is for examination and approval of quarantine.

4. How to Post Objects Prohibited from Entering China for Research and Teaching Purpose?

For posting quarantine objects, specified in the Catalogue of Animals, Animal Products and Other Quarantine Objects Prohibited from Being Carried or Posted into the People’s Republic of China and the List of Plants That are Prohibited from Importation for Quarantine Reasons, into the borders for the purpose of such particular needs as scientific research and teaching, etc., formalities of special approval of quarantine shall be gone through.

5. How to Post Animal Products other than Those Specified in the Catalogue of Animals, Animal Products and Other Quarantine Objects Prohibited from Being Carried or Posted into the People’s Republic of China?

For posting the animal products which are not listed in the Catalogue of Animals, Animal Products and Other Quarantine Objects Prohibited from Being Carried or Posted into the People’s Republic of China into the borders, the recipients shall apply in advance to the AQSIQ, or an inspection and quarantine bureau authorized by and directly under the AQSIQ at the place where the port of entry is for examination and approval of quarantine.

6. How will the inspection and quarantine authorities handle entry postal articles subject to further quarantine?

For entry postal articles subject to further quarantine, inspection and quarantine authorities shall go through the formalities of handover with postal authorities. After completion of the formalities, the inspection and quarantine authorities shall seal them up and notify the recipients. The span of the period of sealing up, generally, shall not exceed 45 days. In case the aforesaid entry postal articles need to be extended due to special circumstances, the inspection and quarantine authorities shall inform the postal authorities and the recipients.

7. What kinds of entry postal articles shall be returned or destroyed by inspection and quarantine authorities?

(1) Those that fail to go through the formalities of examination and approval of quarantine in accordance with relevant provisions, or that fail to execute it in accordance with relevant provisions on examination and approval of quarantine;

(2) Those with insufficient documents;

(3) Those that cannot pass the quarantine and undergo an effective treatment; and

(4) Those that need to be returned or destroyed.

For returning entry postal articles, the inspection and quarantine authorities shall issue relevant documents, in which reasons for carrying out the treatment of returning shall be presented. Postal authorities shall be in charge of returning these documents to the recipients; for destroying entry postal articles, the inspection and quarantine authorities shall issue relevant documents, and notify the recipients after the registration with postal authorities.

 

II FAQs on Quarantine of Articles Carried by Passengers

1. Why should the inspection and quarantine authorities implement entry-exit animal and plant quarantine on diplomatic personnel enjoying diplomatic and consular privileges and immunities?

For entry animals and plants, animal and plant products, or other quarantine objects carried by foreign institutions or personnel enjoying the diplomatic and consular privileges and immunities for public or self use, quarantine shall be conducted in accordance with provisions provided for in the Quarantine Law of Entry-exit Animals and Plants and its implementation regulations. The provision is very necessary, due to the entry-exit animal and plant quarantine is comprehensive, especially concerning entry quarantine. In order to prevent diseases, insect pests or harmful organisms of foreign animals and plants from spreading in China through any possible channel, the quarantine of animals and plants, animal and plant products, or other quarantine objects carried by foreign mission or diplomatic personnel is very essential. That is, animals and plants, animal and plant products, or other quarantine objects carried by foreign mission or diplomatic personnel are also possible to carry animal or plant diseases, insect pests, or harmful organisms, and pose danger to Chinese production safety of agriculture, forestry, and animal husbandry. Therefore, undertaking quarantine is an essential way to prevent foreign epidemic diseases from entering China.

2. What kinds of articles carried by entry-exit personnel are subject to declaration to entry-exit inspection and quarantine authorities and quarantine?

(1) Animals and plants, animal and plant products, and other quarantine objects;

(2) Microorganism, human tissue, biological products, blood and its products, and other special articles (hereinafter referred to as “special articles”).’

(3) Entry and exit Skeletons, bone ash, corpse and coffins with corpse;

(4) The baggage and articles entering or exiting China coming from an affected region or polluted by a contagious disease or probably spreading a contagious disease; and

(5) Other articles that are subject to declaration and quarantine at an entry-exit inspection and quarantine institution

3. What kinds of articles are prohibited from being carried into China?

(1) In accordance with the provision prescribed in the Paragraph 1, Article 5 of the Law of People’s Republic of China on Entry-Exit Animal and Plant Quarantine, animals prohibited from entering China defined by the State include:

a. Pathogenic micro-organisms (including seed cultures of bacteria and viruses) of animals and plants, insect pests and other harmful organisms);

b. Relevant animals and plants, their products and other quarantine objects from countries or regions with prevalent epidemic animal or plant diseases;

c. Animal carcasses; and

d. Soil.

(2) Following plants, plant products shall not be carried into China, in accordance with provisions provided for in the List of Plants That are Prohibited from Importation for Quarantine Reasons:

Zea mays, soybean seeds, stem tubers or other propagating materials of solanum tuberosum, sprouts and quicksets of ulmus species, seedlings and cions of  pinus specicies,  seedlings, sprouts and seeds of hevea species, propagating materials and leafs of nicotiana species, Triticum aestivuml (commodity), fruit, solanceous vegetables (eggplants, chilli, and tomatoes, etc.), phytopathogen (including bacterial strains, virus strains, etc. ), insect pests, harmful organisms, and other genetically modified materials, and soil.

(3) Following animals and animal products shall not be carried into China, in accordance with provisions provided for in the Catalogue of Animals, Animal Products and Other Quarantine Objects Prohibited from Being Carried or Posted into the People’s Republic of China:

Animals: Gallus domestiaus, Anatidae, Chrysolophus amherstiae, Strigiformes, Columba livia, Coturnix coturnix, Aves , Leporidae, Rattus norvegicus, Mus musculus, Cavia porcellus, Sciurus vulgaris, Eutamiassibiricus, Ranidae, snakes, Lacertilia, Crocodylidae, Ranidae, Metaphire posthuma, Fruticicolidae, fishes, macruran, brachyuran, Cercopithecidae, Manis pentadactyla, Felis lynx, Apis, and Bombyxmori, etc.

Animal products: sperm, embryos, germ cells, graines, raw meats, preserved hams, sausages, brawns, bacons, eggs, aquatic products, fresh milk, whey powder, hides and skin, mane, bone, blood, blood meal, grease, and viscera, etc.

Other quarantine objects: bacterial strains, virus strains, pest strains, cells, blood serum, animal specimen, animal carcass, animal wastes, and products may be contaminated by infectious disease pathogens.

(4) The blood products and used articles as prescribed explicitly by the state and other relevant articles prohibited from entering China.

4. How to carry plant seeds, seedlings and propagating materials into China?

For plant seeds, seedlings, or other propagating materials, carried by passengers, that are not prescribed in the List of Plants That are Prohibited from Importation for Quarantine Reasons, formalities of examination and approval of quarantine shall be gone through at departments of agriculture or forests in advance in accordance with relevant provisions. Moreover, passengers shall present the Quarantine Form for Introducing Seeds and/or Seedlings for Examination and Approval or the Quarantine Form of Examination and Approval for Introducing Seeds, Seedlings and Other Reproductive Materials (hereinafter referred to as the Quarantine Form of Examination and Approval for Seeds and Seedlings), when entering the country. Those who are unable to apply in advance, for certain reasons, shall apply for making up formalities of examination and approval for quarantine, in accordance with relevant provisions.

For plant seeds, seedlings or other propagating materials, carried by passengers, and specified in the List of Plants That are Prohibited from Importation for Quarantine Reasons, into China for scientific purpose or other special needs, formalities of special examination and approval of quarantine shall be gone through to the AQSIQ in advance in accordance relevant provisions. Moreover, documents as the Entry Animal and Plant Quarantine Permit of People’s Republic of China issued by the AQSIQ and the quarantine certificate and relevant documents officially issued by the export country (or region) shall be provided when the passengers enter the borders.

An inspection and quarantine institution shall, in accordance with provisions provided for in the Quarantine Form of Examination and Approval for Seeds and Seedlings or the Quarantine Permit or other relevant regulations, perform the on-the-spot quarantine on above-mentioned animals and plants, their products or other quarantine objects

For those who fail to provide the Quarantine Form of Examination and Approval for Seeds and Seedlings, the Quarantine Permit or other relevant documents, the inspection and quarantine institution shall undertake temporary detention to the entry animals and plants, their products, or other quarantine objects, and issue the Voucher for Detaining or Quarantine Treatment. Those animal and plants, animal and plant products, or other quarantine objects detained temporarily shall be sealed up on the sites prescribed by the inspection and quarantine institution. The period of detention shall not exceed 7 days, and the expense for preservation shall be borne by the entry or exit personnel. 

5. How to carry objects prohibited from being carried into China as specified in Paragraph 1, Article 5 of the Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine for scientific purpose or other special needs?

For carried articles, which are specified in the Paragraph 1 of the Article 5 of the Law of the People’s Republic of China on Entry and Exit Animal and Plant Quarantine, prohibited from entering china, formalities of special examination and approval of quarantine shall be gone through to the AQSIQ in advance in accordance with relevant provisions. Moreover, documents as the Entry Animal and Plant Quarantine Permit of People’s Republic of China issued by the AQSIQ and the quarantine certificate and relevant documents officially issued by the export country (or region) shall be provided when the passengers enter the borders.

6. What are the regulations on bringing a cat, a dog or other companion animals into China?

For bringing companion animals (dogs, or cats) into China, the amount of animals shall not exceed the limitation (one passenger one companion animal). Moreover, a passenger who brings an animal must have an effective quarantine certificate officially issued by the outward country or region and an effective certificate of vaccination. The inspection and quarantine institution shall, in accordance with relevant provisions, perform on-the-spot quarantine. Should be found qualified through the on-the-spot quarantine, the animal shall be sent to an isolated site designated by the port animal and plant quarantine institution and undergo isolation quarantine for 30 days.

For those who fail to provide an effective quarantine certificate and certificate of vaccination, the inspection and quarantine institution shall undertake temporary detention to the entry animals, and issue a voucher of detention and quarantine treatment. Those entry animals detained temporarily shall be isolated in an isolation court designated by the animal and plant quarantine institution. The period of detention and isolation shall not exceed 7 days. During the detention, the entry or exit passenger or personnel shall submit relevant effective documents. For those who fail to submit the effective documents during detention, the inspection and quarantine institution shall, in accordance with relevant provisions, return or destroy the animal in a specified period. The payment of expense of detention and isolation shall be effected in accordance with relevant provisions.  

7. What kinds of articles carried by passengers shall be returned within a time limit or destroyed in accordance with related stipulations?

(1) Carried objects that are not in conformity with those described in the documents;

(2) Carried objects detained temporarily in the event of the owner failing to provide relevant effective documents in advance and even during the period of detention;

(3) Those cannot pass the quarantine (including on-the-spot quarantine) and without an effective treatment of disinfection and disinfestation;

(4) Those entry animals whose amount exceeds the limitation;

(5) Those prohibited from entering China prescribed by laws or regulations; and

(6) Others that shall be returned or destroyed in a specified period.

8. What’s the legal basis for quarantine of articles carried by entry-exit personnel?

In order to prevent infectious diseases and their medical vectors, animal infectious diseases, verminosis and harmful diseases, insect pests and weeds dangerous to plants, or other harmful organisms from spreading into or out of the country, as well as to protect people’s health and the safety of agriculture, forestry, animal husbandry and fishery, inspection and quarantine authorities shall undertake quarantine on articles carried by entry-exit personnel in accordance with provisions provided for in the Law of the People’s Republic of China on Entry and Exit Animal and Plant Quarantine and its implementation regulations, the Law of the People’s Republic of China on Health Border Quarantine Inspection and its detailed rules for implementation, Management Methods of Quarantine on Articles Carried by Entry-Exit Personnel, and other laws and regulations.

9. What kinds of personnel shall apply for quarantine of articles carried by them?

"Articles Carried by Entry-Exit Personnel and Subject to Quarantine” means articles carried by inward or outward passengers (including foreign institutions or personnel enjoying the diplomatic and consular privileges and immunities ) or other personnel or the staff of means of transport, or objects consigned by a vehicle, ship or airplane the owner embarking.
